Contract formation

These terms and conditions (“Terms”) apply to the sale of all goods online between Cat Northfield (UK) (“we/us”) and any visitors (“you”) to the website at www.catnorthfield.com (“Site”). For all pre- and post-sale enquiries, please contact catnorthfield@gmail.com

No contract shall exist between you and us for the sale of any goods until we accept your order after payment online.

By placing an order for any goods with age restrictions, you declare that you are age eighteen or over in order to purchase the goods.

The price and description of the goods are displayed on our Site. Such information is subject to change without notice. If you want to enquire about a product, please contact catnorthfield@gmail.com

Subject to clauses 4 and 6, the price you shall pay for the goods is the price displayed on our Site at the time we receive your order. Please be aware that if you are based outside the UK your purchase may be subject to import duty in the destination shipping country.

In the event that you order an item and the price published on the Site is incorrect for any reason, we will contact you to let you know the correct price and ask you whether you still wish us to fulfil your order at this price. We shall be under no obligation to fulfil an order for a product which was advertised at an incorrect price. We shall give you the option of confirming the order at the correct price or if you so choose, to cancel the order altogether, in which case we will issue a full refund of any amount charged.

We endeavour to ensure that all of the items shown on the Site are accurately represented. There may, however, be some slight variations (and this should be expected) between what you see and what you receive in any order, which you agree to accept, provided the variations are not substantial. We may correct any typographical or other errors or omissions in any online entry, sales literature, quotation or other online document relating to the sale of the goods without any liability to you.

The price of the goods is payable in full at point of sale.

Receipts for payment will be sent by email after payment for any purchases made online from the Site. All goods remain our property until cleared payment is received from you.

Availability

All goods are subject to availability.

If we are unable, for any reason, to deliver the goods ordered by you, we will inform you of this as soon as possible and give you the option of providing you with substitute goods of equivalent quality and price, or a full refund.
Delivery

Delivery will be made as soon as possible after your order has been accepted. We always aim to dispatch goods promptly, but there may be delays in the event of holidays, etc. If we are unable to deliver the goods within thirty days of your order, we will inform you as soon as possible and you will be entitled to cancel the order and obtain a refund or re-credit for any sum that has been paid by you or debited from your credit card for the goods. We will not be liable for any loss or damage suffered by you through any reasonable or unavoidable delay in delivery.

We will deliver the goods ordered by you to the address given by you for delivery at the time you place the order.
Right to Cancel

You may cancel an order for goods for any reason within fourteen working days, beginning with the day on which you received the goods.

If you wish to cancel an order within this timeframe, you should notify us by email at catnorthfield@gmail.com You will be responsible for the cost of returning the goods.

When returning goods, it is your responsibility to take reasonable care to see that the goods are not damaged, either whilst in your possession or in transit. We reserve the right to deduct a charge to put the item back into the condition in which it was sold where it has been damaged or is showing signs of wear and tear.

You must return the goods within fourteen days of cancellation and at your own expense. We shall provide a full refund for goods returned or cancelled in accordance with these Terms as soon as possible and in any event within a period not exceeding fourteen days of receiving the goods back or proof that they have been sent back (whichever earlier). Any other refund not satisfying the above conditions will be made at our discretion only. Your statutory rights are not affected.
Warranties

The goods are warranted free from defects in material and workmanship for three months from delivery. This warranty does not apply to any defect in the goods arising from wear and tear, wilful damage, negligence by you or any third party, use otherwise than as recommended by us, failure to follow our instructions, or any alteration or repair carried out without our approval. This warranty does not affect your rights as a consumer.

If the goods supplied to you develop a defect while under warranty, or you have any other complaint about the goods, please email us at the address given above.
Liability

If either you or we are in breach of these Terms, neither of us will be responsible for any losses that the other suffers as a result, except those losses which are a foreseeable consequence of the breach and shall not in any event include losses related to any business of yours such as lost data, lost profits or business interruption.

The entire liability of either you or us in respect of any claim in connection with these Terms shall not exceed the price paid for the goods in question.
Force Majeure
We shall not be liable to you for any failure to deliver the goods that have been ordered by you or any delay, damage or defect to the goods collected which is caused by any event or circumstance beyond our reasonable control.
Return Information
How to return your order
We hope that you are happy with your purchase. If for any reason you’re not entirely satisfied with your order – whether you have changed your mind or decided, you just don’t like it – we will gladly offer you a refund within 14 days of purchase. Under the Distance Selling Regulations, if you buy merchandise online, your consumer rights entitle you to a full refund if you request one in writing within 14 working days of receiving your items. This includes any delivery charge but does not include the cost of returning the item.
If there’s a problem with your item (if we’ve made a mistake, or if your order arrives damaged) please try to let us know immediately by emailing catnorthfield@gmail.com. If we agree that the goods are defective, you will either be refunded in full (including a refund of the delivery charges for sending the item to you and the cost incurred by you in returning the item to us) within 14 days of receipt of the returned goods, or we will replace the goods free of charge (in which case we will refund your reasonable costs in returning the goods to us).
Once we’ve received the item with a copy of the invoice, we will process your refund or replacement as quickly as possible. Please make sure you return the item in pristine condition, in its original packaging.
If you are outside of the UK and wish to return an item, any international customs duties and/or sales taxes paid will not be reimbursed.
If you are owed a refund, we will issue this using the same payment details that were used to purchase the items. We aim to process all returns within 5 working days, but the refund could take up to an additional 5 working days to show in your account. Please note this can take longer when the card used is registered to an address outside of the UK.
When you return goods to us:
Because you have cancelled the contract between us within the fourteen-day cooling-off period described above, we will process the refund due to you as soon as possible and, in any case, within 14 days of the day you have given notice of your cancellation. In this case, we will refund the price of the goods in full, including the cost of sending the item to you. However, you will be responsible for the cost of returning the item to us.

Because the goods supplied are defective, we will first examine the returned goods in order to assess your entitlement to a refund. If we agree that the goods are defective, you will either be refunded in full (including a refund of the delivery charges for sending the item to you and the cost incurred by you in returning the item to us) within 14 days of receipt of the returned goods, or we will replace the goods free of charge (in which case we will refund your reasonable costs in returning the goods to us). We shall have no further liability to you once you have been so refunded or the goods in question have been replaced. If you do not notify us of a defect in any goods, we shall have no liability for any defects and you shall be bound to pay for the goods.

For any other reason, we will refund the value of the goods supplied or exchange the goods in question, provided that they are returned to us in their original, undamaged packaging within 14 days of delivery. If we find that the goods have not been returned to us in fully resaleable condition, we reserve the right to refuse a refund on the item, or deduct up to 20% of the original selling price from the refund amount. If the value of the goods is to be refunded, we will also refund the standard delivery charge made on orders if the goods are returned to us within 14 days of receipt. If the value of the goods is to be refunded but an order is returned to us after 14 days from the day of receipt, then we will refund the delivery charge only if the goods supplied were incorrect. If applicable, we will repay you the value of the goods within 14 days from receipt of the returned goods without any further charge to you except the direct cost of returning the goods.

Any goods to be returned must be returned, along with their original invoice. Returned goods should be sent by recorded delivery.
Our usual refund policy does not apply to made-to-order goods such as prints and personalised greetings cards, which cannot be returned or exchanged unless faulty.
In some cases we may require you to return defective goods to us at our cost cost.
